These Terms and Conditions (“Legal Terms”) govern your use of the website https://makeyourhamper.co.uk (the “Site”) and any related products and services (collectively, the “Services”) provided by Make Your Mark Mcr Ltd, trading as “Make Your Hamper” (“Company”, “we”, “us”, or “our”). By using the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you must not use the Services.
The Services curate and sell hampers based on user input. Availability may vary and contents may change based on stock. The Services are intended for users aged 18+ (or under 18 with a parent or guardian’s involvement). Delivery is to UK addresses only. We aim to deliver within 7 working days and in any case within 30 days of order (in line with UK consumer law). Risk passes on delivery.
We own or license all intellectual property in the Services, including content and trademarks. Subject to these Legal Terms, we grant you a revocable, non-transferable, non-exclusive licence to access the Services for personal, non-commercial use. No other rights are granted. You warrant that your submitted information is accurate and that you will keep it up to date; you have capacity to agree; you will not use the Services for unlawful purposes; and you will comply with applicable laws.
Under the Consumer Contracts Regulations 2013, you may cancel within 14 days of receiving the goods. Notify us by email or post within 14 days; then return items within a further 14 days in their original condition and packaging. We will refund the purchase price (including basic delivery) within 14 days of receiving the goods or proof of postage. Upgraded delivery (e.g., express) is non-refundable unless the item is faulty.
Exclusions: personalised or made-to-order hampers, perishable goods, and opened sealed hygiene products (unless faulty or misdescribed).
You must cover return postage unless we agree otherwise or the item is faulty or not as described. Faulty items are covered by the Consumer Rights Act 2015.
You must not misuse the Services, attempt to breach security, scrape or data-mine without consent, upload malware, harass others, infringe intellectual property, or otherwise act unlawfully or in a manner that interferes with the proper functioning of the Services.
If we provide areas to post content (e.g., reviews), you warrant you have the rights to that content, it does not infringe rights or laws, and it meets our guidelines. You remain the owner of your content; however, you grant us a licence to host and display it as necessary to provide the Services.
By sending suggestions, ideas, or feedback, you grant us the right to use them for any lawful purpose without compensation.
Reviews must be based on genuine experience, be lawful and respectful, and avoid confidential or offensive content. We may moderate or remove reviews at our discretion.
We may monitor, restrict, or remove content; limit access to the Services; and manage capacity to protect our rights and ensure proper operation.
Your use of the Services is subject to our Privacy Policy (see the separate Privacy popup). The Services are hosted in the UK; by using them from elsewhere, you consent to UK processing.
We may suspend or terminate access without notice for breach of these Legal Terms or where required by law.
These Legal Terms are governed by the laws of England and Wales. Non-exclusive jurisdiction: the courts of England and Wales. Consumers in the EU may have additional protections in their country of residence.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This does not affect your statutory rights (e.g., under the Consumer Rights Act 2015).
We will not be liable for indirect, consequential, special, or punitive damages (including loss of profit, revenue, or data). For faulty or misdescribed goods, our liability is limited to the price paid, without prejudice to your statutory rights.
You agree to indemnify us against losses arising from your breach of these Legal Terms, infringement of rights, or unlawful use, subject to our duty to mitigate loss. We may assume control of the defence at our expense.
We may retain data transmitted through the Services to operate and improve them. We take reasonable steps to back up data, but you are responsible for your own backups. We are not liable for loss or corruption of user data, without prejudice to data subject rights under applicable law.
You consent to electronic communications and records. Electronic signatures and contracts are valid and enforceable to the fullest extent permitted by law.

Make Your Hamper is independent. We are not affiliated with, endorsed by, or officially connected to any brands, manufacturers, or companies whose products appear in our hampers or materials.
